3. Parent and Guardian Responsibilities

Parents and Guardians play an important role in supporting the safety, supervision, and educational experience of Students using the Services. By permitting a Student to access or use the Services, the Parent or Guardian agrees to supervise and support the Student’s use of the Services in accordance with Applicable Laws, these Policies, and the Terms.

Parents and Guardians acknowledge that BrightChamps does not provide continuous supervision of Students and that supervision of minors remains the responsibility of the Parent or Guardian, except to the extent expressly required under Applicable Laws.

BrightChamps reserves the right to restrict, suspend, or terminate access to the Services where a Parent, Guardian, or Student violates these Policies, the Terms, safeguarding standards, or Applicable Laws, or where such action is reasonably necessary to protect the safety, integrity, security, or lawful operation of the Services.

4. Student Safety and Safeguarding

BrightChamps is committed to maintaining a safe, respectful, and age-appropriate learning environment for Students and Users. BrightChamps may implement reasonable safety, safeguarding, moderation, monitoring, and compliance measures designed to protect Students, Users, instructors, and the integrity of the Services.

Users shall not use the Services in any manner that endangers, exploits, harms, or may reasonably be considered inappropriate for minors or educational environments.

Without limitation, Users shall not:

  • share, request, solicit, or disclose personal contact information, including personal phone numbers, email addresses, residential addresses, social media accounts, financial information, passwords, or other sensitive personal information through the Services except where expressly permitted by BrightChamps;

  • attempt to contact minors outside authorised educational interactions facilitated through the Services;
  • misuse recordings, screenshots, images, chat messages, or classroom materials involving Students or other Users.

BrightChamps reserves the right, but not the obligation, to monitor, review, moderate, record, investigate, remove, restrict, or report classes, sessions, communications, content, accounts, or activities connected with the Services for purposes including:

  • student safety and safeguarding;
  • legal and regulatory compliance;
  • fraud prevention;
  • abuse prevention;
  • dispute resolution;
  • policy enforcement;
  • quality assurance;
  • platform integrity; and
  • protection of Users and the Services.

Users acknowledge and agree that certain classes, sessions, chats, communications, or activities may be monitored or recorded by BrightChamps for safeguarding, compliance, support, training, moderation, security, or operational purposes in accordance with the Privacy Policy and Applicable Laws.

BrightChamps reserves the right to take any action it reasonably considers necessary to protect Students, Users, instructors, or the Services, including:

Nothing in this Policy limits any mandatory reporting, child protection, safeguarding, or legal obligations applicable under relevant laws or regulations.

5. Instructor and Contractor Independence

BrightChamps may engage instructors, educators, mentors, tutors, trainers, contractors, vendors, consultants, or other service providers in connection with the Services.

Unless expressly stated otherwise in a written agreement executed by BrightChamps, all instructors, educators, mentors, tutors, trainers, and similar personnel providing services through or in connection with the Platform act solely as independent contractors or independent service providers and not as employees, agents, partners, joint venturers, representatives, or legal affiliates of BrightChamps.

Nothing contained in the Services, these Policies, or any related materials shall be construed as creating:

  • an employer-employee relationship;
  • agency relationship;
  • partnership;
  • joint venture;
  • fiduciary relationship; or
  • representative authority — between BrightChamps and any instructor, educator, contractor, or service provider.

Instructors and service providers are independently responsible for:

  • their conduct, communications, teaching methods, statements, opinions, content, and interactions;
  • compliance with Applicable Laws and professional obligations;
  • ensuring that their conduct remains appropriate for educational environments and minors; and
  • adhering to BrightChamps policies, safeguarding standards, and platform requirements.

Any views, opinions, beliefs, comments, recommendations, instructional approaches, cultural observations, political statements, religious statements, personal expressions, or other content expressed by instructors, educators, or Users are solely their own and do not represent, reflect, or constitute the views, policies, endorsements, approvals, or positions of BrightChamps.

To the fullest extent permitted under Applicable Laws, BrightChamps shall not be responsible or liable for:

  • independent acts, omissions, statements, or conduct of instructors, contractors, service providers, or Users;
  • personal opinions, political views, religious commentary, cultural remarks, or subjective statements expressed during sessions or interactions;
  • disputes arising between Users and instructors;
  • off-platform interactions or arrangements; or
  • conduct occurring outside BrightChamps’ reasonable control.

Users acknowledge that live educational environments may involve spontaneous interactions, discussions, questions, and responses, and BrightChamps does not guarantee or warrant that all statements made by Users or instructors will be error-free, universally accepted, culturally neutral, or aligned with every individual viewpoint or expectation.

BrightChamps reserves the right, but not the obligation, to monitor, review, moderate, restrict, suspend, remove, investigate, or terminate instructors, contractors, content, or sessions that violate Applicable Laws, safeguarding requirements, platform standards, these Policies, or the Terms, or that BrightChamps reasonably determines may create safety, legal, operational, reputational, or compliance risks.

Nothing in this Section limits BrightChamps’ rights or obligations under Applicable Laws, including obligations relating to child safety, safeguarding, mandatory reporting, platform compliance, consumer protection, or lawful investigations.

6. Prohibited Uses

Users may access and use the Services solely for lawful, authorised, educational, and legitimate purposes in accordance with these Policies, the Terms, Applicable Laws, and any instructions issued by BrightChamps.

  • initiate fraudulent, abusive, bad-faith, excessive, or repetitive refund requests, disputes, reversals, or chargebacks;

Users acknowledge that BrightChamps may use automated systems, internal review mechanisms, fraud prevention tools, behavioural analysis, audit logs, and operational reviews to detect suspected abuse, fraud, misuse, policy violations, chargeback risks, safeguarding concerns, or unauthorised activities connected with the Services.

7. Recordings and Privacy Expectations

To support educational delivery, student safety, safeguarding, quality assurance, compliance, dispute resolution, training, operational support, and platform integrity, BrightChamps may record, monitor, review, or retain certain classes, sessions, communications, interactions, chats, support interactions, or activities conducted through the Services, to the extent permitted under Applicable Laws.

Where required under Applicable Laws, including children’s privacy and data protection laws, BrightChamps obtains or relies upon appropriate parental, guardian, user, contractual, or other legally valid authorisations, permissions, or consents for such recording, monitoring, processing, and retention activities.

Users acknowledge and agree that:

  • live sessions, classes, demonstrations, chats, or communications may be monitored or recorded;
  • recordings may include audio, video, screen activity, chat messages, shared content, assignments, submissions, or interactions occurring during participation in the Services;
  • recordings and related information may be used for educational, safeguarding, safety, moderation, legal, compliance, training, fraud prevention, customer support, dispute resolution, platform improvement, and operational purposes; and
  • BrightChamps may retain such recordings and related information for periods reasonably necessary under the Privacy Policy, legal obligations, safeguarding requirements, operational needs, or Applicable Laws.

Users should avoid sharing:

  • highly sensitive personal information;
  • financial information;
  • passwords or authentication credentials;
  • government-issued identification details;
  • health or medical information unless specifically required;
  • personal contact details; or
  • any confidential or inappropriate information — during classes, recordings, chats, or interactions connected with the Services.

Users shall not independently record, reproduce, distribute, publish, share, livestream, or commercially exploit classes, sessions, recordings, images, communications, or educational content without prior written authorisation from BrightChamps and any permissions required under Applicable Laws.

BrightChamps implements commercially reasonable safeguards designed to protect recordings and related information; however, no platform, network, transmission, or storage system can be guaranteed to be completely secure.

Further information regarding recordings, privacy practices, data handling, retention, parental rights, and user rights is available in the Privacy Policy.

8. Payments, Refund Abuse and Fraud Prevention

Users agree to provide accurate, complete, current, and lawful payment, billing, account, verification, and transaction information in connection with the Services.

BrightChamps reserves the right to implement reasonable verification, fraud prevention, risk assessment, compliance, authentication, and security measures in connection with purchases, subscriptions, refunds, credits, promotions, discounts, payment methods, and access to the Services.

Without limitation, BrightChamps may:

  • verify payment methods, account ownership, identity, age, parental authority, or transaction authenticity;
  • request additional documentation or information reasonably necessary to investigate suspicious activity, fraud risks, chargebacks, refund requests, or policy violations;
  • delay, refuse, restrict, suspend, reverse, or cancel transactions, credits, promotional benefits, discounts, referrals, withdrawals, refunds, or access to Services where reasonably necessary for fraud prevention, compliance, operational, legal, safeguarding, or security purposes;
  • investigate suspected unauthorized, fraudulent, deceptive, abusive, excessive, or bad-faith payment or refund activity; and
  • cooperate with payment processors, banks, financial institutions, regulators, law enforcement agencies, or fraud prevention providers in connection with investigations or legal compliance obligations.

Nothing in this Section limits any rights or remedies available to BrightChamps under the Terms, Refund Policy, Applicable Laws, payment provider rules, or contractual obligations.

9. Enforcement Rights

BrightChamps reserves the right, at its sole discretion and to the fullest extent permitted under Applicable Laws, to investigate, monitor, review, moderate, restrict, suspend, remove, or take action against any Account, User, content, communication, activity, transaction, class, or conduct that BrightChamps reasonably believes:

  • based on automated systems, manual reviews, internal investigations, complaints, behavioural signals, moderation activities, audit logs, or other reasonably available information.

BrightChamps’ failure to enforce any provision of these Policies or the Terms in a particular instance shall not constitute a waiver of its right to enforce such provisions in the future.

BrightChamps does not guarantee that every report will result in action, removal, suspension, investigation outcome, or response within a specific timeframe.

Where reasonably necessary for safeguarding, security, legal compliance, operational integrity, or protection of Users or the Platform, BrightChamps may take interim or immediate action before completing a full investigation.

11. Limitation of Platform Responsibility

Users acknowledge and agree that BrightChamps provides a technology-enabled educational platform that facilitates classes, interactions, communications, educational activities, and related services involving Users, Students, Parents, Guardians, instructors, contractors, and other participants.

To the fullest extent permitted under Applicable Laws, BrightChamps does not control and is not responsible for:

  • the conduct, actions, omissions, communications, statements, behaviour, or interactions of Users, Students, Parents, Guardians, instructors, contractors, or third parties;

  • uninterrupted, error-free, or incident-free interactions;
  • educational compatibility or satisfaction between participants; or
  • the outcome of any interaction, session, class, communication, or relationship formed through the Services.

While BrightChamps may implement moderation, safeguarding, verification, compliance, reporting, monitoring, or enforcement measures, BrightChamps does not guarantee that all conduct, communications, or content will always comply with these Policies, community standards, safeguarding expectations, or Applicable Laws.

Users acknowledge that:

  • online interactions inherently involve risks;
  • educational environments may involve spontaneous discussions, communications, or interactions;
  • BrightChamps cannot guarantee prevention of all misconduct, offensive conduct, policy violations, technical failures, or unauthorized acts; and
  • any reliance on interactions, statements, content, recommendations, or conduct occurring through the Services is undertaken at the User’s own risk.

To the fullest extent permitted under Applicable Laws, BrightChamps shall not be liable for any acts, omissions, conduct, communications, disputes, damages, injuries, losses, or claims arising from or relating to interactions between Users, Students, Parents, Guardians, instructors, contractors, or third parties, except to the extent liability cannot lawfully be excluded under Applicable Laws.
